elementor - v3.18.0 - 20-12-2023 *\/\n.elementor-widget-text-editor.elementor-drop-cap-view-stacked .elementor-drop-cap{background-color:#69727d;color:#fff}.elementor-widget-text-editor.elementor-drop-cap-view-framed .elementor-drop-cap{color:#69727d;border:3px solid;background-color:transparent}.elementor-widget-text-editor:not(.elementor-drop-cap-view-default) .elementor-drop-cap{margin-top:8px}.elementor-widget-text-editor:not(.elementor-drop-cap-view-default) .elementor-drop-cap-letter{width:1em;height:1em}.elementor-widget-text-editor .elementor-drop-cap{float:left;text-align:center;line-height:1;font-size:50px}.elementor-widget-text-editor .elementor-drop-cap-letter{display:inline-block}<\/style>\t\t\t\t<p><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">HomeVitalyze Monthly Agreement\u00a0<\/span><\/p><p><b>Agreement between HomeVitalyze <\/b><span style=\"font-weight: 400;\">(hereinafter referred to as \u201cHomeVitalyze\u201d) and the client (hereinafter referred to as \u201cClient\u201d).\u00a0<\/span><\/p><ol><li><b> Scope of Monthly Services:\u00a0<\/b><\/li><\/ol><ul><li><span style=\"font-weight: 400;\"> HomeVitalyze agrees to perform a <\/span><b>monthly service <\/b><span style=\"font-weight: 400;\">of the property located at [Property Address].\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\"> The service will address all items designated for service under the chosen monthly subscription plan (see plans for <\/span><span style=\"font-weight: 400;\">full list <\/span><span style=\"font-weight: 400;\">of services provided).\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\"> HomeVitalyze will provide a written report detailing findings after each monthly inspection.\u00a0<\/span><\/li><\/ul><ol start=\"2\"><li><b> Subscription and Automatic Renewal:\u00a0<\/b><\/li><\/ol><ul><li><span style=\"font-weight: 400;\"> The Client subscribes to the monthly inspection service, which will <\/span><b>automatically renew <\/b><span style=\"font-weight: 400;\">each month unless canceled by either party.\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\"> Renewal will occur on the same day of the month as the initial subscription.\u00a0<\/span><\/li><\/ul><ol start=\"3\"><li><b> Scheduling and Allocated Time:\u00a0<\/b><\/li><\/ol><ul><li><span style=\"font-weight: 400;\"> The Client must <\/span><b>schedule <\/b><span style=\"font-weight: 400;\">each monthly inspection in advance.\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\"> The allocated time for each inspection may not be sufficient to address all service items comprehensively.\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\"> If certain items cannot be addressed during a particular month, they will be carried over to the following month.\u00a0<\/span><\/li><\/ul><ol start=\"4\"><li><b> Variable Service Items:\u00a0<\/b><\/li><\/ol><ul><li><span style=\"font-weight: 400;\"> The Inspector and Client acknowledges that certain service items may or may not be addressed based on <\/span><b>Age of Appliances<\/b><span style=\"font-weight: 400;\">: Older appliances may require more attention.\u00a0<\/span><\/li><li><b>Access<\/b><span style=\"font-weight: 400;\">: Limited access areas may impact service items.\u00a0<\/span><\/li><li><b>Scope of Work<\/b><span style=\"font-weight: 400;\">: The agreed-upon scope may affect the depth of services provided.\u00a0<\/span><\/li><\/ul><ol start=\"5\"><li><b> Limited Liability Protections:\u00a0<\/b><\/li><\/ol><ul><li><span style=\"font-weight: 400;\"> The parties agree that the Inspector and its employees are <\/span><b>limited in liability <\/b><span style=\"font-weight: 400;\">to <\/span><b>two (2x) times a single monthly fee paid <\/b><span style=\"font-weight: 400;\">for the services and report.\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">This limitation applies in the event that the Client or any third party claims that HomeVitalyze is liable for negligently performing the services.\u00a0<\/span><\/li><\/ul><ol start=\"6\"><li><b> Disclaimer of Warranties:\u00a0<\/b><\/li><\/ol><ul><li><span style=\"font-weight: 400;\"> HomeVitalyze makes no warranties or guarantees regarding the condition of the property.\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\"> Any reports provided are not a warranty or insurance policy.\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\"> HomeVitalyze performs services that do not require industry certifications or licensing. If any licensing is required to address any service items as part of the monthly service, HomeVitalyze holds the right to refuse service of said items.\u00a0<\/span><\/li><\/ul><ol start=\"7\"><li><b> Ownership of Reports:\u00a0<\/b><\/li><\/ol><ul><li><span style=\"font-weight: 400;\"> The Client may use the reports for personal reference but may not distribute or reproduce them without written consent.\u00a0<\/span><\/li><\/ul><ol start=\"8\"><li><b> Dispute Resolution:\u00a0<\/b><\/li><\/ol><ul><li><span style=\"font-weight: 400;\"> Any disputes arising from this agreement will be resolved through mediation or arbitration.\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\"> Litigation will be the last resort.\u00a0<\/span><\/li><\/ul><ol start=\"9\"><li><b> Modification and Waiver:\u00a0<\/b><\/li><\/ol><ul><li><span style=\"font-weight: 400;\"> Any modifications to this agreement must be in writing.\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\"> Failure to enforce any provision does not constitute a waiver of rights.\u00a0<\/span><\/li><\/ul><ol start=\"10\"><li><b> Forum Selection:\u00a0<\/b><\/li><\/ol><ul><li><span style=\"font-weight: 400;\"> Any legal action must be filed in the county or district where HomeVitalyze principal place of business is located.\u00a0<\/span><\/li><\/ul><ol start=\"11\"><li><b> Severability:\u00a0<\/b><\/li><\/ol><ul><li><span style=\"font-weight: 400;\"> If any provision of this agreement is found to be invalid, the remaining provisions shall remain in effect.\u00a0<\/span><\/li><\/ul><ol start=\"12\"><li><b> Acknowledgment:\u00a0<\/b><\/li><\/ol><ul><li><span style=\"font-weight: 400;\"> The Client acknowledges that they have read and understood
